These terms are an agreement between you and ElevateRx Consulting PLLC, an Idaho professional limited liability company doing business as 440 Sales (“440 Sales”, “we”, “us”). They cover your use of 440sales.com and everything on it (the “Service”). By using the Service, signing in or buying a pass, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use the Service.
You must be at least 18 years old to create an account or buy a pass.
440 Sales publishes catalog information for Quarter Horse yearling sales, restated in our own format from public sale catalogs and results, and adds a “paper value”: a statistical estimate of what a yearling may sell for, with a range, a model cap, the factors behind the estimate, and comparable sales. It also lets you keep your own notes, x-ray status, scores, price limits, photos and shortlist, and sync them between your devices.
Paper values, ranges, caps, price drivers, comps and every other number in the Service are statistical estimates produced by a model from past sale prices and catalog data. They are not appraisals, valuations, veterinary opinions, or financial, legal or purchasing advice, and they can differ from what a horse actually sells for, sometimes by a lot. The model cannot see a horse's physical condition, veterinary findings, or conditions in the sale ring.
You are solely responsible for your bidding, buying and selling decisions. Don't rely on the Service in place of your own inspection, a veterinary examination, the official sale catalog and announcements, and advice from professionals you trust. Catalog information may contain errors or be out of date; the sale company's official catalog and announcements control.
Payments are processed by Stripe; we never see or store your full card number. All pass sales are final and non-refundable, except that we will refund a duplicate charge or a charge made in error, and any refund required by law. If you think you were charged incorrectly, email support@440sales.com before contacting your bank, and we'll sort it out.
Your notes, x-ray status, scores, price limits, photos and shortlist (“Your Content”) are yours. You give us permission to store, copy, process and display Your Content only as needed to run the Service for you, for example to sync it between your devices. Your Content is private to your account. If we later offer shared groups, content you choose to share will be visible to members of that group.
You're responsible for Your Content, including having the right to take and upload any photos and following the rules of the sale company and facility where you take them.

The Service, including the model, the estimates it produces, our text, design and software, belongs to 440 Sales and is protected by law. Catalog facts belong to their respective owners and are used to describe the horses offered. Names of sale companies, horses, sires and farms are used only to identify them. 440 Sales is independent and is not affiliated with or endorsed by any sale company, racetrack or breed association.
The Service relies on providers including Stripe (payments), Supabase (accounts and data) and Amazon Web Services (hosting and email). Your payment is also subject to Stripe's terms. See our Privacy Policy for what each provider handles.
We work to keep the Service available, including during sales, but we don't guarantee it will be uninterrupted, error-free or available at any particular time, and outages can happen during a sale. Much of the Service keeps working on your device without a connection, but save anything critical somewhere else too.
The Service and all estimates and information in it are provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement, to the fullest extent permitted by law.
To the fullest extent permitted by law: (a) 440 Sales will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or opportunity; (b) 440 Sales will not be liable for any loss arising from the purchase, sale, price, condition or performance of any horse, or from any decision you make using the Service; and (c) 440 Sales' total liability for all claims relating to the Service will not exceed the amount you paid us in the 12 months before the claim, or $50 if you paid nothing.
Some places don't allow some of these limits; where that's the case, they apply only as far as the law allows.
If you break these terms or misuse the Service, and a claim is brought against 440 Sales as a result, you agree to cover our reasonable costs and losses from that claim, including reasonable legal fees.
You can stop using the Service at any time and ask us to delete your account (see the Privacy Policy). We may suspend or close an account that breaks these terms, without refund of any pass. If we ever shut the Service down, we'll post notice on the site in advance where we reasonably can.
We may update these terms. We'll change the effective date above and, for significant changes, post a notice on the site. Continuing to use the Service after a change means you accept the updated terms.
These terms are governed by the laws of the State of Idaho, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Idaho, and you and we consent to their jurisdiction, except that either of us may bring a claim in small claims court where it qualifies.
If any part of these terms can't be enforced, the rest stays in effect. Our not enforcing a term isn't a waiver. You may not transfer these terms; we may transfer them as part of a sale or reorganisation of our business. These terms and the Privacy Policy are the whole agreement between us about the Service.
